Terms of Service

1. Acceptance of Terms

By accessing or using Dealer Service Tracker("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of a dealership or organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Platform.

2. Description of Service

Dealer Service Tracker is a web-based service management platform that enables automotive dealerships to track and manage vehicle service workflows using a kanban-style board. The Platform supports Used Inventory, Customer Service, and We Owe ticket types with role-based access control.

3. Account Registration and Access

Access to Dealer Service Tracker is provided through dealership accounts created during the onboarding process. Individual user accounts are created by dealership administrators. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Acceptable Use

You agree to use Dealer Service Tracker only for its intended purpose of managing dealership service operations. You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to other dealerships' data or accounts
  • Interfere with or disrupt the Platform's infrastructure or security features
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use automated scripts, bots, or scrapers to access the Platform
  • Upload malicious code, viruses, or any harmful content
  • Share your login credentials with unauthorized individuals
  • Use the Platform to store information unrelated to dealership service operations

5. Data Ownership

Your dealership retains ownership of all data entered into the Platform, including service tickets, customer information, vehicle details, and notes. We do not claim any ownership rights over your data.

You grant us a limited license to store, process, and display your data solely for the purpose of providing the Platform's services to you.

6. Customer Data Responsibilities

The Platform allows you to store customer personal information (names and phone numbers) within service tickets. As the data controller for this customer information, your dealership is responsible for:

  • Obtaining any necessary consent from customers before entering their information
  • Complying with applicable privacy laws regarding customer data (including CCPA, state privacy laws, and any industry-specific regulations)
  • Responding to customer requests regarding their personal information
  • Ensuring that users within your organization handle customer data appropriately

7. Service Availability

We strive to maintain high availability of the Platform but do not guarantee uninterrupted or error-free service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control.

8. Intellectual Property

The Platform, including its design, code, features, and documentation, is the intellectual property of Dealer Service Tracker and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Platform as described herein.

9. Limitation of Liability

To the maximum extent permitted by law, Dealer Service Tracker and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Platform.

Our total liability for any claims arising from or related to these Terms or the Platform shall not exceed the total amount paid by your dealership to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Dealer Service Tracker and its operators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

Either party may terminate the service relationship at any time. Upon termination:

  • Your access to the Platform will be revoked
  • We will retain your data for 90 days to allow for data export, after which it will be deleted or anonymized
  • Any outstanding payment obligations remain in effect

We may immediately suspend or terminate your access if we determine that you have violated these Terms.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Platform at least 30 days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Cook County, Illinois.
